AS Law: an abusive use of stop and search?
Watch this video of a stop and search from 2008 at the Climate Camp gathering at Kingsnorth in Kent. Are the stop and searches legal? Also look at http://news.bbc.co.uk/1/hi/england/7940128.stm and the linked pages to gain more of an insight into policing at the Climate Camp (and some interesting definitions of weapons by the police). Please comment on the issue 'Individual Rights v Police Investigative Powers'.

From the video you could argue hat it was abuse of the power u.S 1of Pace as they were in breach of individual rights concerning the fact that they were searching everyone who was entering the camp when s.1 of Pace states that they 'may only search on reasonable grounds for suspecting possesion of stolen goods or prohibited articles' on the other hand you could argue that they were within the power of s 60 of the CJPOA(1994) as it gives them right to s&s in anticipation of violence inthe area where a senior constable has authorised,on some occations protests tend to have violence involved.

officer seemed to be quite unreasonable, giving no valid reaason, except for that the person may be carrying a prohibited article, he did refer to s1 of PACE, so i dont think it was an abuse of their powers
Yes the stop and searches were legal as the police gave their name, station and reason for stopping and searching public. Also, the cop later gave additional information as to why he was stopping and searching all members of the public who wished to attend the camp gathering. ie.The Criminal Justice and Pblic Order Act 1994.
